An In re Barr plea can be used as a way to plead guilty to a lesser charge. The In re Barr plea can be used as a negotiation tool. Therefore, a plea does not become invalid when one opts to plead to a lesser related charge that was not actually committed to avoid a conviction for a greater offense. However, the court must still find a factual basis to support the original charge. The defendant must understand the relationship of his conduct to that charge.
